Refund and Cancellation Policy



1. Introduction
1.1. This Refund and Cancellation Policy ("Policy") governs the terms under which clients ("Client", "You") may cancel their engagement with coaching programs, digital courses, community access, or other services ("Services") provided by THRIVOLOGY LIMITED T/A Femmeprenista ("Femmeprenista", "We", "Us", "Our") and the conditions under which any refunds are processed.
1.2. This Policy is an integral part of Our main Terms and Conditions. By purchasing or accessing any Femmeprenista Services, You agree to be bound by this Policy and Our Terms and Conditions.
1.3. We are committed to delivering high-value Services. Should You encounter challenges, We encourage You to contact Us promptly at info@femmeprenista.com to discuss how We might provide support within the scope of the purchased Service.
2. Core Principle: Services are Non-Refundable
2.1. General Policy: As detailed in Our Terms and Conditions, all fees paid for Femmeprenista Services are strictly non-refundable once purchased, accessed, or commenced. This applies whether fees are paid upfront or via an agreed instalment plan.
2.2. Immediate Value: Our Services often involve immediate access to valuable intellectual property (including digital content, course materials, frameworks, community platforms) and/or the reservation of dedicated coaching time. This access and reservation constitute immediate value delivery.
2.3. Exceptions: The only exceptions to this non-refundable policy are:
a) Limited statutory cancellation rights during the initial 14-day "cooling-off period" for distance contracts, ONLY where these rights have not been lawfully waived by You requesting immediate service commencement (see Section 3).
b) Where Femmeprenista explicitly offers a specific, conditional money-back guarantee in writing for a particular program, and the Client meets ALL stipulated conditions for that guarantee (see Section 4).
3. Your Statutory Cancellation Rights & Immediate Service Commencement
3.1. The 14-Day Cooling-Off Period (UK Consumer Contracts Regulations 2013):
a) For contracts concluded "at a distance" (e.g., online), UK consumers typically have a 14-day period after the contract is made to cancel services for any reason.
b) Waiver for Immediate Access: Femmeprenista Services (including digital content, community access, and coaching programs like Spark, Launch, Momentum, and Ascend) are designed for immediate engagement and value delivery. To facilitate this, as a condition of purchase allowing immediate access, We require Your explicit agreement to waive the standard 14-day full refund right under the Regulations.
c) Your Explicit Consent and Acknowledgement: During the checkout or sign-up process, before completing your purchase, You will be required to provide Your express consent for the Service (including access to digital content, community, or commencement of coaching) to begin immediately (i.e., before the end of the standard 14-day cancellation period). You must also explicitly acknowledge that by providing this consent:
i. If You subsequently choose to cancel within the initial 14 days after the service has begun, You will be required to pay Us an amount proportionate to the service provided up until the time You informed Us of Your cancellation; AND
ii. You will lose your right to cancel and receive a refund under the Regulations if the Service is fully performed within the 14-day period.
d) Consequence of Not Consenting: If You do not provide this explicit consent and acknowledgement, immediate access to the Services cannot be granted. Access will be delayed until the 14-day cooling-off period has expired.
e) Exercising Cancellation (Where Right Exists): If You have not provided the explicit consent and acknowledgement for immediate start and wish to cancel within the initial 14 days, You must notify Us via email at info@femmeprenista.com. A full refund will be issued provided no Service access was granted.
3.2. Subscription Services (If Applicable):
a) For recurring subscription plans (e.g., monthly community access), You may cancel future payments by providing written notice to info@femmeprenista.com at least [e.g., 7 business days] prior to your next billing date.
b) Cancellation prevents future charges but does not trigger a refund (full or partial) for the current or any previous billing periods.
c) Access typically continues until the end of the billing period for which payment has already been received.
3.3. Fixed-Term Programs & Coaching Packages (Spark, Launch, Momentum, Ascend):
a) These Services are sold as defined packages for a set fee, whether paid upfront or via an agreed instalment plan.
b) Once the 14-day cooling-off period has expired OR You have lawfully waived your cancellation rights by providing explicit consent for immediate service commencement (as per Clause 3.1.c), Your commitment is binding for the full term and fee of the package.
c) Cancellation by Client: If You choose to cancel or cease participation after this point, You are not entitled to any refund (full or partial) of fees already paid.
d) Instalment Plans: If You are utilising an instalment plan, You remain legally obligated to complete all remaining payments according to the agreed schedule, irrespective of Your continued participation in the program. Failure to complete payments constitutes a breach of contract (see Terms and Conditions Clause 5.1).
e) Consequences of Cancellation/Default: Femmeprenista reserves the right to immediately revoke access to all program materials, community platforms, coaching support, and other Service elements upon Client cancellation or default on payments. We also reserve the right to pursue outstanding payments legally.
3.4. Individual Session Cancellation & Rescheduling (Momentum & Ascend Programs)
a) Applicability: This clause applies specifically to scheduled one-to-one coaching sessions within the Momentum and Ascend programs.
b) Rescheduling Requires Notice: If You need to reschedule an agreed-upon coaching session, You must provide Us with written notice via email to Your designated coach (or info@femmeprenista.com if no specific coach email is provided) at least twelve (12) hours prior to the scheduled start time of the session.
c) Consequences of Insufficient Notice or No-Show: If You provide less than twelve (12) hours written notice to reschedule, or if You fail to attend a scheduled session without any prior notice (a "no-show"), that session will be immediately forfeited. The session will be deemed to have taken place, You will be charged for it accordingly (as part of Your package fee), and it cannot be rescheduled or refunded.
d) Rescheduling Limit: To maintain program momentum and respect scheduling commitments, Clients are permitted a maximum of three (3) rescheduled sessions throughout the entire duration of their Momentum or Ascend coaching package term, provided the required 12-hour notice (as per Clause 3.4.b) is given for each instance. Any requests to reschedule beyond this limit will be treated as a cancellation with insufficient notice (as per Clause 3.4.c), resulting in the forfeiture of the session.
e) How to Reschedule: Timely rescheduling requests (meeting the 12-hour notice requirement) should be made via email, proposing alternative availability. Rescheduling is subject to mutual agreement and coach availability.
f) Coach Cancellations: In the unlikely event that Femmeprenista needs to reschedule a session with reasonable notice, We will work with You to find a suitable alternative time at no penalty to You.
3.5. Group Program Session Attendance (Spark & Launch)
a) Scheduled live group coaching sessions are fixed components of the Spark and Launch programs.
b) Client non-attendance at any scheduled live group session, for any reason, does not entitle the Client to a partial or full refund.
c) Access to program materials and resources continues as per the program structure. Recordings of live sessions are typically provided within the program platform, offering value even if the live attendance is missed.
4. Program-Specific Money-Back Guarantees
4.1. Femmeprenista operates on the principle that client results are dependent on client commitment, effort, and consistent action. Therefore, We do not offer conditional money-back guarantees based on satisfaction or specific outcomes for our standard Services (including Spark, Launch, Momentum, Ascend).
4.2. The non-refundable policy outlined in Section 2 and Section 3.3 applies unequivocally to these programs, subject only to the limited statutory rights discussed in Section 3.1 where applicable and not waived. Any statement suggesting a guarantee elsewhere is superseded by this Policy unless provided as an explicit, written addendum signed by a Director of THRIVOLOGY LIMITED.
5. How to Request Cancellation
5.1. All requests for cancellation must be submitted in writing via email to info@femmeprenista.com.
5.2. Your request must include:
a) Your full name and the email address used for purchase.
b) The specific name of the Program or Service You wish to cancel.
c) The date of purchase.
d) A clear statement confirming Your intention to cancel.
5.3. We will acknowledge receipt of Your cancellation request, typically within [e.g., 5-7 working days], and confirm the implications based on this Policy (e.g., cessation of access, ongoing payment obligations if applicable).
6. Refund Processing (Limited Circumstances)
6.1. Refunds are only processed in the exceptionally limited circumstances outlined in Clause 2.3 (i.e., valid exercise of unwaived statutory cooling-off rights, or meeting all strict conditions of a formally offered guarantee which is not standard practice).
6.2. If a refund is formally approved by Us in writing, it will be processed within [e.g., 14 working days] of the approval confirmation.
6.3. Refunds will be issued to the original payment method, less any amounts due for services provided (as per Clause 3.1.c.i) or any applicable transaction fees where permitted. Bank processing times may vary.
7. Femmeprenista's Right to Cancel/Terminate
7.1. As stated in Our Terms and Conditions, Femmeprenista reserves the absolute right to suspend or terminate a Client's access to any or all Services immediately and without notice for reasons including, but not limited to, non-payment of fees, breach of contract terms, violation of community guidelines, or conduct deemed detrimental to the Femmeprenista community or brand.
7.2. In the event of termination by Femmeprenista due to Client breach or non-payment, no refunds for any fees already paid will be provided, and any outstanding fee obligations remain due.
8. Policy Updates
8.1. Femmeprenista reserves the right to amend this Refund and Cancellation Policy at any time. The revised policy will be effective immediately upon posting to Our website or otherwise notifying Clients. The "Last Updated" date indicates the latest revision.
